Australian law recognises a broader range of legally significant relationship categories, including De facto and Separated. Interestingly, these concepts reflect evolving social realities and may offer a glimpse into the possible future direction of family law reform in China.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">01 \u4f20\u7edf\u56db\u5927\u5a5a\u59fb\u72b6\u6001\uff08\u9ad8\u5ea6\u5bf9\u5e94\uff09<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u5728\u57fa\u7840\u7684\u5a5a\u59fb\u72b6\u6001\u5206\u7c7b\u4e0a\uff0c\u4e2d\u56fd\u548c\u6fb3\u5927\u5229\u4e9a\u5b58\u5728\u5b8c\u5168\u5bf9\u5e94\u7684\u56db\u4e2a\u6982\u5ff5\u3002\u65e0\u8bba\u662f\u65e5\u5e38\u767b\u8bb0\u8fd8\u662f\u6cd5\u5f8b\u9002\u7528\uff0c\u5176\u5b9a\u4e49\u57fa\u672c\u4e00\u81f4\uff1a<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u672a\u5a5a\uff08Never Married\uff09\uff1a\u4ece\u672a\u5efa\u7acb\u8fc7\u6cd5\u5b9a\u5a5a\u59fb\u5173\u7cfb\u3002<\/li>\n\n\n\n<li>\u5df2\u5a5a\uff08Married\uff09\uff1a\u4f9d\u6cd5\u786e\u7acb\u5e76\u6301\u7eed\u5b58\u5728\u7684\u5a5a\u59fb\u5173\u7cfb\u3002<strong>\u4e0d\u8fc7\u6fb3\u6d32\u6709\u7ed3\u5a5a\u51b7\u9759\u671f\uff0c\u6cd5\u5b9a\u7ed3\u5a5a\u5e74\u9f84\u662f18\u5c81\uff0c\u7279\u6b8a\u60c5\u51b5\u53ef\u4ee5\u964d\u4f4e\u3002<\/strong><\/li>\n\n\n\n<li>\u79bb\u5a5a\uff08Divorced\uff09\uff1a\u4f9d\u6cd5\u89e3\u9664\u5a5a\u59fb\u5173\u7cfb\u540e\u7684\u72b6\u6001\u3002<strong>\u4e0d\u8fc7\u4e2d\u56fd\u6709\u79bb\u5a5a\u51b7\u9759\u671f\u3002<\/strong><\/li>\n\n\n\n<li>\u4e27\u5076\uff08Widowed\uff09\uff1a\u56e0\u914d\u5076\u53bb\u4e16\u800c\u5bfc\u81f4\u5a5a\u59fb\u5173\u7cfb\u7ec8\u6b62\u540e\u7684\u72b6\u6001\u3002<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the most fundamental level, China and Australia recognize four equivalent categories of marital status. Their legal definitions are largely consistent for both administrative registration and legal application:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Never Married: A person who has never entered into a legally recognized marriage.<\/li>\n\n\n\n<li>Married: A legally established and subsisting marital relationship.<\/li>\n\n\n\n<li>Divorced: A marital relationship that has been legally dissolved in accordance with the law.<\/li>\n\n\n\n<li>Widowed: The marital status of a person whose spouse has passed away, resulting in the termination of the marriage.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">02 \u6838\u5fc3\u5dee\u5f02\u6982\u5ff5\u4e00\uff1a\u4e8b\u5b9e\u5a5a\u59fb \/ \u5173\u7cfb\uff08De facto\uff09<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u8fd9\u662f\u4e2d\u6fb3\u5a5a\u59fb\u6cd5\u5f8b\u5236\u5ea6\u4e2d\u6700\u5927\u3001\u6700\u663e\u8457\u7684\u5dee\u5f02\u4e4b\u4e00\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u6fb3\u6d32\u7684 De facto\uff08\u4e8b\u5b9e\u5a5a\u59fb\uff09<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. \u72ec\u7acb\u72b6\u6001<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u5728\u6fb3\u6d32\uff0cDe facto \u662f\u4e00\u79cd\u88ab\u6cd5\u5f8b\u5b8c\u5168\u627f\u8ba4\u7684\u72ec\u7acb\u5a5a\u59fb\u72b6\u6001\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. \u5e7f\u6cdb\u5305\u5bb9\u6027<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u8be5\u5173\u7cfb\u65e2\u53ef\u4ee5\u5b58\u5728\u4e8e\u540c\u6027\u4f34\u4fa3\u4e4b\u95f4\uff0c\u4e5f\u53ef\u4ee5\u5b58\u5728\u4e8e\u5f02\u6027\u4f34\u4fa3\u4e4b\u95f4\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. \u6ce8\u518c\u673a\u5236<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u6fb3\u6d32\u591a\u6570\u5730\u533a\uff08\u5305\u62ec\u65b0\u5dde\u3001\u7ef4\u5dde\u3001\u6606\u5dde\u3001\u5357\u6fb3\u3001\u9996\u90fd\u9886\u5730\u53ca\u5854\u5dde\uff09\u5141\u8bb8\u5bf9\u8be5\u5173\u7cfb\u8fdb\u884c\u5b98\u65b9\u6ce8\u518c\uff0c\u5e76\u652f\u6301\u5176\u4e2d\u4e00\u65b9\u8eab\u5904\u5883\u5916\u529e\u7406\u6ce8\u518c\u624b\u7eed\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u76ee\u524d\uff0c\u897f\u6fb3\u5927\u5229\u4e9a\u5dde\uff08WA\uff09\u548c\u5317\u9886\u5730\uff08NT\uff09\u5c1a\u4e0d\u80fd\u529e\u7406\u8be5\u7c7b\u5173\u7cfb\u6ce8\u518c\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. \u79fb\u6c11\u6cd5\u89c6\u89d2<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u5728\u6fb3\u6d32\u79fb\u6c11\u6cd5\u4e2d\uff0cDe facto \u901a\u5e38\u88ab\u7406\u89e3\u5e76\u89c6\u540c\u4e8e\u7c7b\u201c\u5df2\u5a5a\u72b6\u6001\u201d\uff0c\u7b26\u5408\u6761\u4ef6\u7684\u4f34\u4fa3\u5173\u7cfb\u53ef\u4ee5\u4f5c\u4e3a\u914d\u5076\u7c7b\u7b7e\u8bc1\u7533\u8bf7\u7684\u91cd\u8981\u4f9d\u636e\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The concept of a De facto relationship represents one of the most significant distinctions between the Chinese and Australian legal systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De Facto Relationship in Australia<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. An Independent Legal Status<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Australia, a De facto relationship is a legally recognized and independent relationship status, separate from marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Broad Inclusiveness<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A De facto relationship may exist between either opposite-sex or same-sex partners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Registration Mechanism<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In most Australian jurisdictions, including New South Wales, Victoria, Queensland, South Australia, the Australian Capital Territory and Tasmania, a De facto relationship may be officially registered. In some circumstances, registration is possible even when one party is overseas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Currently, however, Western Australia (WA) and the Northern Territory (NT) do not provide a registration scheme for De facto relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. No Directly Corresponding Legal Concept<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Modern Chinese law does not recognize an independent legal status equivalent to Australia&#8217;s De facto relationship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Emerging Judicial Trends<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, Chinese courts have increasingly recognized certain legal rights arising from cohabitation relationships, particularly in disputes involving property accumulated jointly by unmarried couples or engaged partners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, in disputes concerning betrothal gifts (Caili), judicial practice, including guidance from the Supreme People&#8217;s Court, has demonstrated a tendency to consider long-term cohabitation without marriage registration as possessing characteristics similar to a factual marital relationship. This may influence the proportion of betrothal gifts that should be refunded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Historical Recognition<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Only relationships established before 1 February 1994 may, under limited circumstances, still be recognized as a de facto marriage under Chinese law.
